Welcome to DO NOT BE A STARVING ARTIST ("Company," "we," "us," or "our"). These Terms of Service govern your access to and use of our website, web-to-print platform, and custom manufacturing services.
By submitting an order, creating an account, or uploading artwork to our platform, you ("Customer," "you," or "your") agree to be bound by this Agreement. If you are placing an order on behalf of a business, client, or entity, you represent and warrant that you have the authority to bind that entity to these terms.
1. Custom Production & Order Processing
Automated Order Queue: Because all products are custom-manufactured in-house, production begins immediately upon order submission.
No Changes or Cancellations: Once checkout is complete, artwork files, item quantities, sizes, and shipping addresses cannot be modified or canceled. Please review all details prior to finalizing your order.
Color and Screen Display Disclaimer: Visual proofs on digital screens operate on an RGB (Red, Green, Blue) color space, whereas physical production equipment prints using CMYK (Cyan, Magenta, Yellow, Key/Black) inks. Minor color variations may occur between screen previews and the final printed product. You are strictly responsible for inspecting design alignment, typography, and spelling prior to submission.
No Automated Artwork Scanning: We do not utilize automated software scanners to check for image resolution, print quality, or copyright compliance upon upload. You bear full responsibility for ensuring submitted artwork meets your required specifications and quality standards.
2. User-Generated Content (UGC) & Intellectual Property
Ownership Affirmation: You guarantee that you are the sole legal owner of all uploaded images, text, logos, and graphic assets ("User Content"), or that you possess explicit written authorization from the rightful copyright or trademark owner to reproduce the content for production.
Limited Fulfillment License: You retain full ownership of your original artwork. By uploading assets, you grant us a non-exclusive, worldwide, royalty-free, temporary license to store, duplicate, modify (solely for layout or sizing purposes), and print your uploaded files strictly as necessary to fulfill your order.
Right of Refusal: We reserve the absolute right, at our sole discretion, to reject, pause, or cancel any order without prior notice if the content contains:
Unlicensed third-party trademarks, logos, or brand names.
Copyrighted photography, watermarked stock assets, or celebrity likenesses used without authorization.
Defamatory, unlawful, harassing, or hate speech material.
Material violating an individual's right of publicity or privacy.
3. Intellectual Property Indemnification (Customer Liability)
Financial Liability Shift: You agree to fully defend, indemnify, and hold harmless DO NOT BE A STARVING ARTIST, its officers, directors, employees, and production partners against any third-party claims, lawsuits, administrative penalties, liabilities, or losses (including all legal fees and court costs) arising from allegations of copyright, trademark, trade secret, or privacy infringement related to your uploaded assets.
Duty to Defend: In the event of an intellectual property claim or legal notice regarding your print order, you assume full financial and legal responsibility to defend or settle the claim on our behalf.
DMCA / Takedown Reporting: Rights holders who believe their work is being reproduced without authorization on our platform may submit formal notices to steve@donotbeastarvingartis.com.
4. Shipping & Delivery Policy
Total estimated delivery time is calculated as follows:
Total Delivery Time = Production Time + Transit Time
Production vs. Transit: Production/manufacturing time typically takes 3–5 business days. Shipping transit time depends on the carrier method selected at checkout.
Carrier Delays: DO NOT BE A STARVING ARTIST is not liable for delivery delays caused by shipping carrier bottlenecks, severe weather, labor strikes, or incorrect shipping addresses provided during checkout.
International Customs, Duties, & Taxes: International orders are shipped on a Delivered Duty Unpaid (DDU/DAP) basis. You or your end-recipient are solely responsible for paying all local customs duties, taxes (VAT/GST), and clearance fees assessed by the destination country. Packages refused due to unpaid duties are non-refundable.
Transfer of Risk: Risk of loss and title for all items pass to you immediately upon our handoff of the parcel to the shipping carrier. We will assist in filing claims for lost or damaged parcels reported within 30 days of scheduled delivery.
5. Returns, Refunds, & Defects
Custom Product Non-Returnable Policy: Custom-printed items cannot be returned or refunded for buyer’s remorse, design miscalculations, or incorrect sizing selection.
Manufacturing Defects & Damage: If an order arrives damaged or with an operational defect (wrong item delivered, severe printing fault):
Email our support team within 14 days of delivery at steve@donotbeastarvingartist.com.
Include your order number and clear photos illustrating the issue.
Remedies: Upon verification of a manufacturing fault, we will reprint and ship a replacement parcel at no extra charge or issue a store credit/refund to your original payment method.
6. General Disclaimers, Cookies, & Website Use
Limitation of Liability: Our website and services are provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, [Your Company Name] disclaims all express or implied warranties and shall not be held liable for indirect, incidental, or consequential damages resulting from your use of our site.
Website Intellectual Property: All site layouts, text, branding, and graphics created by DO NOT BE A STARVING ARTIST are our protected property and may not be copied, scraped, or republished without written consent.
